Moving from the “dialogue between Courts” that culminated in the Constitutional Court judgment no. 84/2021, this paper focuses on the scope of the “nemo tenetur se detegere” principle within the context of criminal matters “in substance”. It explores the various forms of “non-cooperation” that fall within – or outside – the integrated protection afforded to this guarantee by both national and supranational legal sources, as well as the adjustments that should consequently be made to the domestic legal system.
