Il giusto processo, questione sempre aperta – Luca Marafioti
A poco più di venticinque anni dall’innesto dei princìpi del giusto processo in Costituzione e dal mirabile scritto di Enrico Marzaduri sul tema, il presente contributo mira a verificare lo stato di effettività di quei valori, muovendo da un interrogativo di fondo: che cosa resta del giusto processo e che cosa, invece, è cambiato. L’art. 111 Cost. risulta ancora oggi fatalmente influenzato dalle scorie del clima politico nel quale ha visto la luce e dalla pretesa natura oggettiva dei suoi addentellati, a tutto danno della dimensione di garanzia per l’individuo sottoposto a processo. L’impoverimento dell’anima soggettiva dei princìpi ivi veicolati – dovuti specialmente a prassi devianti e alle recenti riforme – rischia, però, di offrire uno strumento di tutela dei diritti della persona non più adeguato rispetto alle nuove sfide tecnologiche e scientifiche. Di qui, la necessità di un profondo ripensamento della tematica, secondo quel che resta dell’insegnamento del Maestro che tale scritto intende omaggiare.
More than twenty-five years after the incorporation of the principles of fair trial into the Italian Constitution and Enrico Marzaduri’s seminal essay on the subject, this contribution seeks to assess the current effectiveness of those values, starting from a fundamental question: what remains of the fair trial, and what has changed? Article 111 of the Constitution is still fatally conditioned by the political climate in which it was conceived and by the supposed objectivity of its framework, to the detriment of its role as a guarantee for the individual facing trial. The erosion of the subjective core of its principles – caused above all by deviant practices and recent reforms – risks rendering it an inadequate safeguard of individual rights in the face of new technological and scientific challenges. Hence the need for a profound rethinking of the matter, in light of what endures of the teaching of the Master to whom this essay pays tribute.
