I paradigmi dell’accertamento penale alla prova delle data-driven investigation – Giulia Lasagni
Il contributo affronta il tema del rapporto fra cooperazione giudiziaria e tecnologia (anche automatizzata) guardando a una specifica applicazione di alcune tecniche di indagine, che hanno costituito il centro delle più recenti evoluzioni giurisprudenziali in materia: le cosiddette data-driven investigation. Due in particolare i profili problematici esaminati: il difficile inquadramento delle operazioni transnazionali di captazione di dati su larga scala, che pongono in rilievo il complicato rapporto fra diritti del giusto processo e tutela della riservatezza, e la questione dell’accesso ai dati, che mette in discussione l’effettività del principio del contraddittorio. L’analisi, tramite una prospettiva interna e comparata, vuole mettere in evidenza come nell’era delle grandi indagini transnazionali e tecnologiche, basate (anche) sull’IA, la definizione del principio della parità delle parti non è solo una questione di diritto, ma anche, più che mai, di infrastrutture.
This paper aims to address the relationship between judicial cooperation and technology (including automated technology) by examining a specific application of certain investigative techniques, which have been at the heart of the most recent developments in case law on the subject: so-called data-driven investigations. Two problematic issues in particular are examined: the difficulty in classifying large-scale cross-border data collection operations, which highlight the complex relationship between the rights to a fair trial and the protection of privacy; and the issue of access to data, which calls into question the effectiveness of the principle of the right to be heard. This analysis, adopting an internal and comparative perspective, aims to show how, in the era of large-scale transnational and technology-driven investigations – based (in part) on AI – the definition of the principle of equality of arms is not merely a matter of law, but also, more than ever, a matter of infrastructure.
