La riforma in materia di sanzioni sostitutive – Alberto Gargani

Lo scritto ha ad oggetto l’intervento di riforma in materia di sanzioni sostitutive (l. 134/2021). Prendendo le mosse dalla crisi di effettività del sistema sostitutivo introdotto con l. 689/1981, si analizza il tentativo di rivitalizzazione dell’istituto attuato mediante l’innalzamento del limite massimo di pena detentiva  sostituibile, la revisione della tipologia delle sanzioni sostitutive e l’esclusione della sospendibilità condizionale delle stesse. Nella seconda parte dell’indagine sono messe a fuoco alcune criticità disciplinari che rischiano di pregiudicare la funzionalità e l’effettività applicativa delle nuove pene sostitutive, nel quadro della crescente divaricazione tra pena edittale e pena inflitta in concreto. 

The article deals with the reform of the substitute sanctions (l. 134/2021). Starting with the crisis of effectiveness of the substitute system introduced by l. n. 689/1981, it is analyzed the attempt to revitalize alternative penalties to prison through the raising of maximum penalty limit that is likely to be substituted, the revision of the substitute punishment forms and the exclusion of the suspension of the sentence. In the second part of the inquiry some critical aspects of the legislative regulation are highlighted, i.e. the underlying factors influencing the effectiveness and the functionality of new substitute penalties, as part of follow-up to the progressive discrepancy between the prescribed by law penalty and the real penalty.
