The criminal law of the family has undergone profound transformations over time by virtue of the profound transformations that the concept of family has undergone. Thus, from the fascist family that placed the male / husband / father at the center, thanks to constitutionalism, we passed to a “democratic” family that places husband and wife on the same level. But society has changed further and the challenge now, with the guidance of reasonableness, is to build a penal system that is able to distinguish from time to time between situations to be treated in the same way, think about the treatment of children born in or out of marriage. or to the treatment of de facto couples with respect to art. 384 of the Criminal Code, and situations to be treated in a differentiated way, think of the need to protect vulnerable individuals who are within the family.
