Giustizia riparativa e pandemia. Spunti di riflessione con particolare riferimento al contenzioso in ambito sanitario – Elena Mattevi
La pandemia ha portato con sé conseguenze che interessano da vicino la giustizia penale. Il conflitto penale in ambito sanitario ha subito un grosso incentivo; esso tuttavia, anche in conseguenza di un recente intervento legislativo, difficilmente esiterà in pronunce di condanna di medici e infermieri. Nel 2020, poi, il legislatore italiano ha introdotto nuove misure, anche penali, per contrastare le aggressioni al personale sanitario. In entrambi i casi, le soluzioni normative offerte si spiegano almeno in parte con il senso di gratitudine nei confronti di questi professionisti, che l’emergenza sanitaria ha suscitato, ma non si dovrebbero dimenticare le ragioni dei pazienti vittime dell’inefficienza del servizio sanitario e l’importanza della dimensione della fiducia nell’alleanza terapeutica. Le vittime reclamano quella verità e giustizia che il sistema giudiziario penale non può offrire. Lo scritto offre alcuni spunti di riflessione sui contributi che la giustizia riparativa può dare, a partire dalla riforma in corso della giustizia penale.
The pandemic has brought consequences that closely affect the criminal justice system. Criminal cases against health professionals have received a major boost. They are, however, even as a consequence of a recent legislative development, unlikely to result in convictions. Finally, in 2020, the Italian legislator adopted new measures, including criminal ones, in order to counter attacks on healthcare workers. In both cases, the regulatory solutions offered are promoted at least in part by a sense of gratitude towards these professionals – fostered by the sanitary emergency – but they should not neglet the reasons of patients who are victims of the inefficiencies of the sanitary system and the importance of mutual trust in the therapeutic alliance. Victims are searching for the truth and justice, that criminal justice system isn’t able to provide.This paper offers some food for thought on the contributions that restorative justice can give, starting with the ongoing reform of the criminal justice system.
